False Claims Compliance and Oversight

Those entities that receive or make annual payments under the State Plan of at least $5,000,000 are required to submit to the Division of Program Integrity (DPI), Department of Health Care Finance, a letter that certifies compliance with the District of Columbia False Claims Act, (D. C. Official Code §2-381.01 et seq., as amended), the Federal False Claims Act (31 U., S. C. §§ 3729-3733) and all relevant requirements found in Section 4, Attachment 4.42-A of the Medicaid State Plan.  

In accordance with the above references, and the District of Columbia Transmittal 13-13, those entities that receive or make annual payments under the State Plan of at least $5,000,000 must comply with the above requirement. Specifically, the letter must state the following: 
1.    The entity is in compliance with 42 U.S.C. §1396a (a) (68) and that the entity has provided continuing education for false claims education during the prior twelve (12) month period.  
2.    It should also state that the entity is in compliance with the District and Federal False Claims Acts.  
3.    It must be signed by the Chief Executive or Chief Operating Officer of the entity. 
The document titled “Attestation of Compliance” is available for download or completion on-line.  
The signed copy of the Attestation of Compliance or a letter that certifies compliance, can be submitted through the DPI website, filled out online and emailed to DPI (see email address below), sent via the mail, or sent via fax. This attestation or letter must be submitted annually, on or before the last business day of each calendar year for which the entity is certifying compliance. It must be signed by the Chief Executive or Chief Operating Officer of the entity.
