Updated Information on Guidance Regarding Conflict-Free Case Management Notice

To Elderly and Persons with Disabilities (EPD) Waiver Providers:
 
On Friday, July 10, DHCF’s Conflict-Free Case Management Services Notice of Emergency and Proposed Rulemaking was published in the DC Register. You can also find it on DHCF’s website on this page at dhcf.dc.gov/.  
 
Per the notice, the emergency rulemaking was adopted on July 1, 2015 and shall become effective for services rendered on or after that date.
 
As part of this notice, there are a series of deadlines providers must be aware of:
 
An individual providing EPD waiver case management services on the effective date of these rules shall have sixty (60) days (until September 1, 2015) from the effective date of these rules to meet the requirements laid out in the rule.
  • Under 29 DCMR Section 4216.3, current case managers are required to complete a self-attestation form demonstrating that they meet the conflict free standards within 60 days of the effective date of the rule.  Per feedback from the DHCF Long-Term Care Provider Leadership Meeting held on July 23, 2015, DHCF is extending the deadline for compliance with this requirement. Specifically, individuals providing EPD waiver case management services will have until July 1, 2016, to comply with the requirement that they submit a self-attestation form.  This change will be reflected in the forthcoming Second Notice of Emergency and Proposed Rulemaking related to Conflict-Free Case Management Services.
  • An entity described in the rule shall notify DHCF of its election to continue or discontinue providing case management services within sixty (60) days of the effective date of these rules, and must submit a completed DHCF Conflict-Free Case Management Provider Decision Form to DHCF ([email protected]) by September 1, 2015.
  • An entity that chooses to discontinue case management services shall securely submit the DHCF Conflict-Free Case Management Transition Template to DHCF ([email protected]) within ninety (90) days (by October 1, 2015) of the effective date of these rules and shall cooperate with DHCF to effectuate the orderly and timely transition of its enrollees to other case management providers that meet the conflict-free case management standards.
